MOOTLU DISTANCE SALES AGREEMENT
ARTICLE 1 – PARTIES
1.1 Seller

1.2 Buyer
The person placing an order from mootlu.com (hereinafter referred to as “BUYER”).
ARTICLE 2 – SCOPE OF THE AGREEMENT
The purpose of this agreement is to regulate the sale, delivery, payment terms, right of withdrawal, and obligations of the parties regarding the products ordered by the BUYER through the SELLER's website.
The BUYER accepts and declares that they have read and electronically approved all preliminary information, including the product's features, sales price, payment method, delivery terms, and right of withdrawal, during the order process, and subsequently placed the order.
The agreement only covers the products ordered by the BUYER. Mootlu has no obligation for continuous or periodic delivery of goods. All products are offered for general consumer access; no special privilege is granted to the BUYER.
ARTICLE 3 – DELIVERY AND DELIVERY COSTS
The product is delivered to the address provided by the BUYER during the order, either to the BUYER or a third party specified by them.
Payment is mandatory for the order to be finalized. The SELLER delivers the product within a maximum of 30 (thirty) days from the approval of payment. If payment does not occur or is canceled, the SELLER is released from the delivery obligation.
ARTICLE 4 – BUYER’S OBLIGATIONS
The BUYER accepts that they have read and electronically confirmed all preliminary information regarding the basic characteristics of the ordered product, its sales price, payment and delivery information, and shipping costs.
The BUYER is obliged to inspect the product upon delivery. If broken, dented, damaged, or poorly packaged products are detected, a report must be prepared with the cargo company, and the product must be returned without acceptance. Otherwise, the product is considered to be sound.
To exercise the right of withdrawal, the SELLER must be notified within 14 (fourteen) days from the delivery of the product. The product must be returned unused and undamaged, along with its box and all accessories.
ARTICLE 5 – SELLER’S OBLIGATIONS
The SELLER is responsible for delivering the ordered product completely, soundly, in accordance with the order, and with any warranty certificates and user manuals.
If it has been agreed to deliver the order to a person other than the BUYER and this person does not accept the product, the SELLER cannot be held responsible.
When the right of withdrawal is exercised, the amount will be refunded to the BUYER's bank account or credit card within 14 (fourteen) days following the receipt of the product and documents by Mootlu.
If delivery becomes impossible due to force majeure or technical obstacles, the SELLER will notify this situation within 3 days and refund the paid amount within 14 days.
Defective products can be sent to Mootlu for return or exchange under warranty. However, the SELLER is not responsible for damages caused by user error.
ARTICLE 6 – PRODUCT CHARACTERISTICS AND PRICE
The type, model, color, quantity, and price, including all taxes, of the product are as stated on mootlu.com
and on the invoice. Shipping costs are added at the payment step.
Interest to be applied in case of delay cannot exceed the Central Bank of the Republic of Turkey's advance interest rate and in no case exceed 30%.
Installment sales can only be made with a credit card. The BUYER learns the number of installments via the website. Additional agreements made with the bank do not bind Mootlu.
ARTICLE 7 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the agreement without giving any reason within 14 days from the date of receiving the product. The withdrawal notification must be made online by entering the order number and email on mootlu.com.
When exercising the right of withdrawal, the product, along with its box and all contents, must be sent to the SELLER. There is no charge for shipments made with the contracted cargo company (Yurtiçi Kargo). For shipments made with other cargo companies, the costs belong to the BUYER.
The right of withdrawal cannot be exercised in the following cases:
- Damage to the product and its accessories,
- Failure to notify withdrawal within the period.
ARTICLE 8 – DEFAULT
If the BUYER defaults on payments made with a credit card, they are obliged to pay interest in accordance with the contract made with their bank. The bank may resort to legal remedies, and demand expenses and attorney's fees.
ARTICLE 9 – APPROVAL OF THE AGREEMENT
This agreement has been prepared within the framework of the Regulation on Distance Contracts and relevant legislation.
The BUYER has read and approved the preliminary information form before completing the order. Electronic approval signifies acceptance of the agreement.
ARTICLE 10 – AUTHORIZED AUTHORITIES
In disputes arising from this agreement, Provincial/District Consumer Arbitration Committees are authorized within monetary limits, and Consumer Courts are authorized in cases exceeding these limits.
The BUYER may apply to the arbitration committee in their place of residence or at the SELLER's location.
